Many Indiana residents are not satisfied with the new law as the medical malpractice cap is one of the lowest in the nation. Originally the governor of Indiana had proposed a cap increase every four years due to the cost of inflation but the proposal was never able to pass because of the opposition it has received from the Indiana State Medical Association.
The Bobbitts family in Indiana are no fans of this new law. They have been fighting for over 10 years after their daughter’s birth caused her to be a quadriplegic and left her unable to speak. The family was awarded $15million dollar in damages; however, the cap that was initiated by Indiana may lower that amount to just over 1 million dollars, an amount the family is not happy with.
According to an Indianapolis Lawyer Indiana law, doctors are responsible for only the first $250,000 in damages related to malpractice. They have a limit of no more than $750,00.00 per year. Currently, the Indiana Patient Compensation Fund pays anything over $750,00.00 up to 1 million.
